Terms of Service Agreement

THIS IS A BINDING LEGAL CONTRACT. PLEASE READ CAREFULLY.

1. PREAMBLE AND ACCEPTANCE

This Terms of Service Agreement ("Agreement") constitutes a legally binding contract between you ("Guardian," "You," or "User") and Narrato.space, a platform operated under the laws of the Federal Republic of Germany ("Narrato," "We," "Us," or "Our").

This Agreement governs your access to and use of the Narrato website, mobile applications, and associated services (collectively, the "Service"). The Service is specifically designed for children aged 7 to 16 ("Child User").

BY CREATING AN ACCOUNT, ACCESSING, OR USING THE SERVICE, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

  • You are the legal parent or guardian of the Child User.
  • You have read, understood, and accept this Agreement.
  • You consent to the collection and processing of your and your Child User's data as described herein and in our Privacy Policy.

If you do not agree to these terms, you must strictly refrain from accessing or using the Service.

2. ACCOUNT REGISTRATION AND ELIGIBILITY

2.1. Guardian Requirement

The Service is strictly prohibited for use by any individual under the age of 18 without the direct consent and ongoing supervision of a legal guardian. You represent and warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement on behalf of yourself and the Child User.

2.2. Account Structure

  • Parent Account: To access the Service, you must create a Parent Account. You are solely responsible for maintaining the confidentiality of your login credentials. Any activity occurring under your account (including activity by your Child User) is your legal responsibility.
  • Child Account: Child Accounts are sub-accounts strictly linked to a Parent Account. A Child Account cannot exist independently.
  • School Account: Accounts created by authorized educational institutions ("School Accounts") are subject to separate verification but remain bound by the conduct and content policies set forth in this Agreement.

2.3. Identity Verification

Narrato reserves the right, at its sole discretion, to require proof of identity and legal guardianship to comply with applicable laws, including but not limited to GDPR-K (EU) and COPPA (US). Failure to provide satisfactory verification upon request will result in immediate suspension or termination of access.

3. USER CONDUCT AND PROHIBITED ACTIVITIES

You acknowledge that Narrato employs a "Zero Tolerance" policy regarding safety violations. You agree to strictly adhere to, and ensure your Child User adheres to, the following covenants.

3.1. Prohibited Acts

You and your Child User are expressly prohibited from:

  • Using the Service for any unlawful purpose or in furtherance of illegal activities.
  • Engaging in bullying, harassment, hate speech, or intimidation.
  • Uploading, posting, or transmitting content depicting violence, gore, sexual acts, nudity, self-harm, or substance abuse.
  • Attempting to circumvent, disable, or reverse-engineer safety features, including the "Lily" AI Guardian or PII redaction filters.
  • Soliciting personally identifiable information ("PII") from other users.
  • Attempting to migrate conversations to unmonitored third-party platforms (e.g., soliciting Discord tags or WhatsApp numbers).
  • Impersonating any person or entity, including Narrato staff.

3.2. Monitoring and Consent

You expressly consent to Narrato’s use of automated technologies (including artificial intelligence) and human moderation to monitor, intercept, and review all text, audio, and visual content transmitted through the Service for the purpose of ensuring user safety.

3.3. Mandatory Reporting and Law Enforcement Cooperation

Narrato operates in strict cooperation with law enforcement agencies within the Federal Republic of Germany (e.g., BKA) and internationally (e.g., Europol, NCMEC).

WE RESERVE THE RIGHT TO TAKE AGGRESSIVE PREEMPTIVE ACTION:

  • Immediate Reporting: In the event that We detect, or reasonably suspect, the presence of Child Sexual Abuse Material (CSAM), grooming behavior, or "Adult Infiltration" (an adult posing as a child), We will immediately report all available data—including IP addresses, device identifiers, chat logs, and metadata—to competent authorities.
  • Missing Children: We will cooperate fully with international investigations regarding missing or exploited children.
  • No Notification Requirement: You acknowledge and agree that Narrato is under no obligation to notify You prior to or after reporting suspicious activity to law enforcement, or upon receipt of a data request from competent authorities. In many jurisdictions, such notification may be prohibited by law during active investigations. We reserve the right to cooperate fully with authorities without your knowledge or consent to protect the safety of children.
  • Indemnification for Reporting: You acknowledge that Narrato prioritizes child safety over privacy. You hereby waive and release Narrato from any claims, damages, or liabilities arising from Our good-faith reporting of suspicious activity to law enforcement, even if such report is subsequently determined to be unfounded.

4. INTELLECTUAL PROPERTY AND CONTENT RIGHTS

4.1. Ownership by Child User

Narrato acknowledges and agrees that the Child User retains 100% legal ownership of all original text, drawings, and creative works ("User Content") created by them on the Service.

4.2. License to Narrato

By uploading or creating User Content, You grant Narrato a limited, non-exclusive, worldwide, royalty-free, and revocable license strictly necessary to operate the Service. This license is limited to:

  • Storing, hosting, and displaying the content to the Child User.
  • Transmitting the content to approved connections (Friends/Family) as directed by the Child User.

MARKETING & ADVERTISING USE (OPT-IN ONLY):

  • Default Status (No Use): By default, We will NOT use, sell, or distribute User Content for marketing, advertising, or promotional purposes.
  • Explicit Opt-In: We reserve the right to use User Content for advertising or marketing ONLY IF You (the Guardian) explicitly grant permission via the specific setting in the Parental Dashboard.
  • Revocation: You may revoke this marketing permission at any time via the Dashboard.
  • No AI Training: Regardless of marketing consent, We will NOT use User Content to train generative artificial intelligence models.

4.3. Right of Removal

Notwithstanding the foregoing, Narrato reserves the absolute right to remove, hide, or delete any User Content that violates this Agreement or Our Community Guidelines, without prior notice or liability.

5. VIRTUAL GOODS ("STARDUST")

  • No Monetary Value: "Stardust," stickers, badges, and other virtual items constitute a limited, non-transferable, revocable license to use digital objects within the Service. They have no real-world monetary value and cannot be exchanged for currency.
  • No Refunds: In the event of account termination for any reason, all accrued Stardust and virtual items are forfeited immediately. Narrato has no obligation to refund or compensate for such forfeiture.

6. GUARDIAN LIABILITY AND INDEMNIFICATION

6.1. Supervision and Liability

You acknowledge that while Narrato utilizes advanced safety technologies, no system is infallible. The Service is a tool, not a substitute for parental supervision.

  • Strict Liability: You accept full legal responsibility for all actions taken and all content transmitted by your Child User.
  • Indemnification: You agree to defend, indemnify, and hold harmless Narrato, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (i) your or your Child User's use of the Service; (ii) your violation of any term of this Agreement; or (iii) your Child User's violation of any third-party right, including without limitation any copyright, property, or privacy right.

6.2. School Context

If you authorize the linking of your Child Account to a School Account, you consent to the disclosure of your Child's school-related activity (assignments, classroom chats) to authorized school personnel.

7. TERMINATION AND DATA RETENTION

7.1. Termination by You (Voluntary)

You may terminate this Agreement and your account at any time via the Parental Dashboard.

  • Data Retention: Upon voluntary termination, We will retain your data for a period of six (6) weeks. This retention is maintained (a) to allow for account restoration should you change your mind, and (b) to preserve evidence for potential legal inquiries.
  • Investigation Hold: If an active investigation or safety report involving the account is pending at the time of termination, data may be retained beyond the 6-week period until the investigation is resolved.

7.2. Termination by Narrato (Involuntary/Ban)

We reserve the right to suspend or terminate your account immediately, without notice, for violation of this Agreement.

  • Data Retention (Activity): If an account is terminated by Us for policy violations, We will retain all account data (chat logs, activity history, metadata) for a minimum of two (2) years for safety auditing and legal compliance purposes.
  • Data Retention (Blacklist): To prevent ban evasion and ensure the safety of our community, We will retain the Guardian's verified identity information (Name, Email, Phone Number, Address, and Device Hash) indefinitely.
  • Law Enforcement Hold: If an account is terminated in connection with a law enforcement investigation (e.g., CSAM, grooming), We will retain ALL data indefinitely until We receive a court order or official confirmation from the investigating authority authorizing deletion.

7.3. Data Download

You may request a download of your Child User's data via the Parental Dashboard. You acknowledge that due to encryption and security processing, the generation of this archive may take up to 72 hours to become available.

8. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

SERVICE "AS IS":
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, NARRATO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS.

ZERO LIABILITY FOR DAMAGES:
IN NO EVENT SHALL NARRATO BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.
  • DAMAGES RESULTING FROM ANY CONDUCT OR CONTENT OF ANY THIRD PARTY OR CHILD USER ON THE SERVICE, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT.
  • DAMAGES RESULTING FROM UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

BASIS OF THE BARGAIN:
YOU AGREE THAT THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION 8 ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN YOU AND NARRATO. YOU ACKNOWLEDGE THAT NARRATO WOULD NOT BE ABLE TO PROVIDE THE SERVICE WITHOUT SUCH LIMITATIONS. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SERVICE OR WITH THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THE SERVICE.

9. DISPUTE RESOLUTION AND GOVERNING LAW

9.1. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law principles.

9.2. Mandatory Pre-Suit Notification and Negotiation

As a condition precedent to filing any lawsuit, claim, or legal action against Narrato, You agree to the following procedure:

  • Written Notice: You must provide Us with written notice at least six (6) weeks prior to initiating any legal action.
  • Content of Notice: This notice must provide a detailed factual and legal basis for your claim ("The Why") and the specific relief you are seeking.
  • Good Faith Negotiation: During this 6-week period, You agree to engage in good-faith negotiations with Us to resolve the dispute out of court.
  • No Arbitration: This clause establishes a mandatory negotiation period but does not mandate binding arbitration. If the dispute is not resolved within six weeks, You may proceed with filing a lawsuit in a court of competent jurisdiction within Germany.

10. MODIFICATIONS TO AGREEMENT

We reserve the right to modify this Agreement at any time. We will provide notice of material changes via email or a prominent notification within the Service. Your continued use of the Service following such notice constitutes your acceptance of the modified Agreement.
